Probate

At LRA LAW we understand that the death of a loved one is one of life’s most difficult experiences. Dealing with the subsequent administration of their Estate can be an added burden during these hard times.

We are here to help you with as much or as little support and advice as you need.

We offer a range of services including:

  • Estate Administration (also known as ‘Probate’)

  • Advice on Intestate Estates (when a person dies without leaving a Will)

  • Inheritance Tax Advice

  • Deeds of Variation

We can help you with all matters from simply applying for the Grant of Representation to dealing with the full administration of the Estate.

The costs involved in dealing with the matter will depend on the amount of work required. We can provide a detailed estimate of costs after the initial meeting.

If we are simply obtaining the Grant without being involved in either the valuation of assets or liabilities or the subsequent administration of the estate, then the costs will be between £1000 – £2,000 plus disbursements. This assumes that no complex Inheritance Tax (IHT) calculation is required. If a complex IHT calculation is required, this will increase the costs.

If we are instructed to deal with the full administration of the Estate then our costs will be based upon a percentage of the Estate unless a separate basis of charging is agreed.

It is difficult to estimate how long the Probate process will take as there are many factors that can affect the timescale. These include delays in obtaining information that is required from third parties as well as delays at the Probate Registry. We would estimate that on average, full administration of an Estate can take between 8-12 months.

In addition, there will be disbursements payable. These include the following:

  •  Probate Court Fees – from £300 plus £1.50 per copy of the Grant of Representation

  • Bankruptcy searches - £2 per beneficiary

  • Statutory Notices to Claimants (Section 27 Notices) in the London Gazette and local paper which act as protection against unknown creditors - £200 estimate

  • Professional valuation fees for property/personal items/investments (depending on various factors)

  • Unoccupied Property Insurance (depending on various factors)
